Menstruation: Tawaf, the Quran, the Mosque, Marital Relations, Divorce and Other Important Rulings

Introduction

The rulings related to menstruation are not limited to prayer and fasting. They also include important matters related to Hajj and Umrah, a woman’s relationship with the Quran, entering and staying in the mosque, marital life, divorce, and other aspects of Islamic practice.

In this article, we discuss important rulings concerning a menstruating woman performing Tawaf around the Ka‘bah, touching the Quran, reciting the Quran orally, studying books of Tafsir, staying in the mosque, marital relations, intercourse during menstruation and its expiation, intercourse before performing Ghusl after menstruation ends, divorce during menstruation, and permissible forms of intimacy. These matters are explained in the light of the Quran, authentic Hadith, and explanations of Islamic scholars.

1. Tawaf Around the Ka‘bah During Menstruation

A woman who is menstruating may perform the other rites of Hajj, but she should delay Tawaf around the Ka‘bah until she becomes pure.

‘Aishah (رضي الله عنها) said that they set out with the Messenger of Allah ﷺ intending to perform Hajj. When they reached Sarif, she began menstruating. The Messenger of Allah ﷺ came to her while she was crying and asked:

“What is wrong with you?”

She replied that she wished she had not intended to perform Hajj that year.

The Prophet ﷺ said:

“This is something Allah has decreed for the daughters of Adam. So do everything that a pilgrim does, except do not perform Tawaf around the House until you become pure.”

Sahih al-Bukhari, Hadith 305; Sahih Muslim, Hadith 1211.

Imam Ibn Rushd رحمه الله wrote that, according to the scholars, menstruation makes four things prohibited:

  • Prayer
  • Fasting
  • Tawaf
  • Intercourse through the private part

Reference: Bidayat al-Mujtahid, 1/85.

Imam Ibn Hazm رحمه الله also considered the prohibition of prayer, fasting, Tawaf, and intercourse through the private part during menstruation to be matters of scholarly consensus.

Reference: Al-Muhalla, 2/162.

2. Touching the Quran During Menstruation

Scholars have discussed the prohibition of directly touching the Quran during menstruation.

It is reported from the Messenger of Allah ﷺ:

“Only a pure person should touch the Quran.”

Reference: Muwatta Imam Malik, Book of the Quran, Chapter: The command to perform Wudu for one who touches the Quran; also al-Daraqutni, 1/219.

The Al-Mawsu‘ah al-Fiqhiyyah also mentions scholarly agreement on this matter.

Imam al-Nawawi رحمه الله stated that a menstruating or postnatal woman is not permitted to touch or carry the Quran, and that staying in the mosque is also prohibited.

Reference: Al-Majmu‘, 2/358.

Imam al-Bahuti رحمه الله wrote that a person in a state of ritual impurity may not touch the Quran or any part of it, including its cover and margins, and that a menstruating woman comes under this ruling as well.

Reference: Al-Rawd al-Murbi‘, 1/9.

It is important here to distinguish between touching the Quran and reciting it orally, because these are separate issues with separate evidence and detailed discussions among the jurists.

3. Reciting the Quran Orally During Menstruation

The ruling on directly touching the physical copy of the Quran and the ruling on reciting the Quran orally during menstruation are two separate issues. Therefore, a ruling concerning oral recitation should not automatically be applied to touching the Mushaf.

The Hanafi Position

According to the Hanafi school, a menstruating woman is not permitted to perform regular oral recitation of the Quran.

One of the pieces of evidence cited for this position is the narration from ‘Abdullah ibn ‘Umar

“A menstruating woman and a person in a state of major ritual impurity should not recite anything from the Quran.”

 Sunan al-Tirmidhi, Hadith 131.

Al-Durr al-Mukhtar with Radd al-Muhtar also mentions the prohibition of Quranic recitation for a menstruating woman.

Reference: Al-Durr al-Mukhtar with Radd al-Muhtar, 1/172.

Some Hanafi scholars and Islamic jurists in the Indian subcontinent have also issued rulings prohibiting oral Quranic recitation during menstruation. Jamia Uloom Islamia Allama Muhammad Yusuf Banuri Town has also issued a fatwa on this issue.

Fatwa: [Fatwa Link]

The Maliki Position

In the Maliki school, there is a well-known position allowing a menstruating woman to recite the Quran orally. This position also takes into consideration the fact that menstruation can continue for a number of days and that a woman may need to maintain her connection with the Quran during this period.

Shaykh al-Islam Ibn Taymiyyah

Shaykh al-Islam Ibn Taymiyyah رحمه الله allowed a menstruating woman to recite the Quran orally, particularly when there is a need.

For example, a woman who is memorizing the Quran may need to recite her lesson in order to maintain it and avoid forgetting it.

Shaykh ‘Abd al-‘Aziz ibn Baz

Shaykh ‘Abd al-‘Aziz ibn Baz رحمه الله also held that a menstruating woman may recite the Quran orally. His position is based on the view that there is no authentic and explicit evidence that definitively establishes a prohibition on Quranic recitation for a menstruating woman.

Therefore, the well-known positions of the Hanafi, Shafi‘i, and Hanbali schools prohibit regular oral recitation by a menstruating woman, while the Maliki school has a well-known position allowing it. Shaykh Ibn Taymiyyah and Shaykh Ibn Baz رحمهما الله also held the permissibility of oral recitation, although their detailed reasoning differs.

It should also be clearly understood that allowing oral recitation does not automatically mean that directly touching the physical Mushaf is also permitted. Touching the Mushaf is a separate issue.

If a woman looks at the Quran, repeats the verses in her heart, and does not pronounce them with her tongue, this is not considered oral recitation. When there is a need, such as reviewing memorized verses in order to avoid forgetting them, there is room for doing this without directly touching the physical Mushaf.

4. Studying Books of Tafsir

A menstruating or postnatal woman may study books of Tafsir, especially books that contain Quranic verses along with explanation, Hadith, Islamic law, and other scholarly material.

However, the physical Mushaf itself is a separate matter, and the ruling concerning directly touching it should be observed as explained above.

The state of Janabah is discussed differently. A person in a state of major ritual impurity does not perform regular Quranic recitation until performing Ghusl. However, there is room to study books that contain Quranic verses together with Tafsir or Hadith, provided that the Quranic verses are not recited as formal Quranic recitation.

It is reported from ‘Ali

“Nothing would prevent the Messenger of Allah ﷺ from reciting the Quran except Janabah.”

Sunan Abi Dawud, Hadith 229; Sunan Ibn Majah, Hadith 594; Musnad Ahmad, 1/124, 84.

A narration in Musnad Ahmad states:

“As for the person in a state of Janabah, not even one verse [should be recited].”

 Musnad Ahmad, 1/110.

Further reference: Majmu‘ Fatawa wa Maqalat Mutanawwi‘ah, 10/211.

5. Staying in the Mosque During Menstruation

Scholars have discussed the prohibition of a menstruating woman staying inside the mosque.

‘Aishah رضي الله عنها reported that the Messenger of Allah ﷺ said:

“Turn these houses away from the mosque, for I do not permit the mosque for a menstruating woman or a person in a state of Janabah.”

Sunan Abi Dawud, Hadith 232.

Hafiz Ibn Hajar رحمه الله mentioned regarding this narration that Imam Ahmad رحمه الله did not consider a problem in its chain, while Ibn Khuzaymah considered it authentic and Ibn al-Qattan considered it Hasan.

Reference: Talkhis al-Habir, 1/140.

Imam Ibn Qudamah رحمه الله wrote that when a woman begins menstruating, she should leave the mosque, and he did not report disagreement among the scholars on this issue.

Reference: Al-Mughni, 4/487.

Passing Through the Mosque When There Is a Need

A distinction is made between staying inside the mosque and passing through it because of a need. If there is a genuine need to pass through the mosque and there is no fear that menstrual blood will contaminate the mosque, this has been considered permissible.

‘Aishah رضي الله عنها reported that the Messenger of Allah ﷺ asked her to bring him a mat from the mosque. She replied that she was menstruating. He ﷺ said:

“Your menstruation is not in your hand.”

Sahih Muslim, Hadith 298.

Qadi al-Shawkani رحمه الله used this Hadith as evidence that a menstruating woman may enter the mosque when there is a need.

Reference: Nayl al-Awtar, 3/327.

Imam al-Tirmidhi also reported that most scholars did not consider it a problem for a menstruating woman to take something from the mosque.

Reference: Sunan al-Tirmidhi, p. 37.

6. Intercourse with One’s Husband During Menstruation

Sexual intercourse through the private part during menstruation is prohibited. There is clear evidence for this in the Quran.

“They ask you about menstruation. Say, ‘It is a harm, so keep away from women during menstruation and do not approach them until they are pure. Then when they have purified themselves, go to them from where Allah has commanded you.’ Indeed, Allah loves those who constantly repent and those who purify themselves.”

Surah al-Baqarah, 2:222.

Anas رضي الله عنه reported that when this verse was revealed, the Companions asked the Messenger of Allah ﷺ about the matter. He ﷺ said:

“Do everything except intercourse.”

Sahih Muslim, Hadith 302.

This shows that Islam does not require complete separation from a menstruating wife. The specific prohibition concerns sexual intercourse through the private part.

7. Expiation for Intercourse During Menstruation

If a man has intercourse with his wife through the private part while she is menstruating, scholars have differed concerning whether an expiation is required.

Some jurists consider an expiation obligatory. This view is also reported from the Hanbali school.

One of the evidences cited is a narration from Ibn ‘Abbas

“Whoever has intercourse with his wife while she is menstruating should give one dinar or half a dinar in charity.”

Sunan Abi Dawud, Hadith 264.

Shaykh al-Albani رحمه الله graded this narration authentic.

According to the Hanafi school, however, an expiation is not obligatory in this situation, although giving charity is considered recommended, and sincere repentance and seeking forgiveness from Allah are necessary.

References: Fiqh al-‘Ibadat, 1/65; Hashiyat al-Tahawi ‘ala Maraqi al-Falah, 2/137.

Therefore, both the view that expiation is obligatory and the view that it is recommended are reported from the scholars.

8. The Amount of Expiation: One Dinar or Half a Dinar?

There is also some detail among scholars concerning the amount of expiation.

A narration from Ibn ‘Abbas رضي الله عنهما states that if intercourse occurred during the earlier part of menstruation, one dinar should be given, while if it occurred toward the end of menstruation, half a dinar should be given in charity.

Reference: Sunan Abi Dawud, Hadith 265.

Some jurists explained this by saying that one dinar should be given during the early days of menstruation, when the bleeding is heavier, and half a dinar during the later stage, when the bleeding has become lighter and is close to ending.

Some scholars have understood one dinar or half a dinar as an option, meaning that either amount may be given.

A similar position has also been attributed to Shaykh ‘Abd al-‘Aziz ibn Baz رحمه الله, allowing a choice between one dinar and half a dinar.

Reference: Muharramat Istahana biha al-Nas Yajibu al-Hadhar Minha, p. 35.

The book Manar al-Sabil also mentions the choice between one dinar and half a dinar.

Reference: Manar al-Sabil, 1/79.

A ruling attributed to the Permanent Committee also states that the person should repent and seek forgiveness and give one dinar or half a dinar in charity.

Reference: Fatawa al-Lajnah al-Da’imah, 5/399.

9. The Approximate Modern Weight of a Dinar

Regarding the weight of a dinar, approximately 4.25 grams of gold, or a very similar amount, is mentioned in Islamic legal sources. Some references mention approximately 4.233 grams.

These amounts are very close to one another. In the present day, this historical monetary amount can be understood by calculating the value according to the weight of gold and its current market price.

If someone needs to actually pay an expiation, it is appropriate to ask a qualified scholar or a reliable Darul Ifta for guidance regarding the current monetary value.

10. Intercourse After Menstrual Bleeding Stops but Before Ghusl

According to the majority of scholars, even after menstrual bleeding has stopped, intercourse through the private part is not permitted until the woman performs Ghusl and becomes pure.

“And do not approach them until they are pure. Then when they have purified themselves, go to them from where Allah has commanded you.”

Surah al-Baqarah, 2:222.

Imam Ibn Qudamah رحمه الله wrote that according to most scholars, intercourse is not permissible after the menstrual bleeding stops until the woman performs Ghusl.

Reference: Al-Mughni, 1/419.

Imam al-Shafi‘i رحمه الله also understood this verse as connecting the permissibility of intercourse with purification through Ghusl after the bleeding has stopped.

Reference: Al-Umm, 1/129.

Shaykh Muhammad ibn Salih al-‘Uthaymeen رحمه الله also considered intercourse before Ghusl impermissible.

Reference: Tafsir al-Quran al-Karim, 3/84.

Therefore, according to the majority of scholars, Ghusl after menstruation is required before intercourse becomes permissible.

11. Is the Woman Also Required to Give Expiation?

If a man has intercourse with his wife through the private part while she is menstruating, the question of expiation for the woman is also discussed alongside the ruling concerning the man.

If the woman willingly participates in the intercourse, some scholars consider that she is also required to give the expiation.

However, if the husband forces the woman to have intercourse against her will, then she is not required to give the expiation.

A general principle cited in this regard is:

“My Ummah has been excused for mistakes, forgetfulness, and what they are forced into.”

Al-Isharat fi Ahkam al-Kaffarat, p. 99.

Imam al-Bahuti رحمه الله also discussed the difference between a willing and a forced situation.

Reference: Kashshaf al-Qina‘, 1/102.

12. Considering Intercourse During Menstruation to Be Permissible

The prohibition of intercourse through the private part during menstruation is clearly established by the Quran and Sunnah. Therefore, knowingly declaring this prohibited act to be permissible becomes a separate and very serious religious matter.

Imam al-Nawawi رحمه الله wrote that the prohibition of intercourse with a menstruating woman is established through the Quran and authentic Hadith, and that scholars have regarded knowingly declaring it permissible as a matter that can reach the level of disbelief.

Reference: Al-Majmu‘, 2/363.

Qadi al-Shawkani رحمه الله also discussed this prohibition on the basis of the Quran, Sunnah, and scholarly consensus.

Reference: Nayl al-Awtar, 1/382.

The well-known Hanafi scholar Imam al-Sarakhsi رحمه الله also wrote that a person who considers intercourse during menstruation permissible is subject to the ruling of disbelief, while a person who believes that it is prohibited but nevertheless commits the sin is considered sinful.

Reference: Al-Mabsut by al-Sarakhsi, 10/158.

However, declaring a specific individual to be a disbeliever is a separate and highly sensitive matter. Such a judgment should be left to qualified scholars rather than ordinary individuals, because the person’s knowledge, intention, interpretation, ignorance, and other circumstances may need to be considered.

13. Divorce During Menstruation

Divorcing a woman while she is menstruating is not the prescribed method of divorce.

“O Prophet, when you divorce women, divorce them at the beginning of their waiting period.”

Surah al-Talaq, 65:1.

This verse indicates the prescribed method of divorce: the woman should be in a period of purity during which her husband has not had intercourse with her, so that her waiting period can begin correctly.

‘Abdullah ibn ‘Umar رضي الله عنهما divorced his wife while she was menstruating. When the Messenger of Allah ﷺ was informed about this, he ordered Ibn ‘Umar to take her back and then instructed him to divorce her at the appropriate time.

Reference: Sahih al-Bukhari, Book of Divorce.

The jurists refer to divorce given during menstruation as Talaq Bid‘i, while divorce given according to the prescribed Sunnah method is called Talaq al-Sunnah.

Therefore, if divorce becomes necessary, the husband should follow the prescribed Islamic method and avoid giving divorce during menstruation.

14. What Forms of Marital Intimacy Are Permissible During Menstruation?

A husband is not required to completely separate himself from his wife during her menstruation. The prohibition specifically concerns intercourse through the private part.

The Messenger of Allah ﷺ said:

“Do everything except intercourse.”

Sahih Muslim, Hadith 302.

Therefore, during menstruation, a husband may:

  • Sit with his wife
  • Eat and drink with her
  • Sleep in the same place
  • Talk with her
  • Show affection and companionship

These ordinary forms of marital interaction are permissible.

However, intercourse through the private part is not permissible until menstruation has ended and the woman has performed Ghusl.

15. Intimacy Between the Navel and Knees

In discussing marital intimacy during menstruation, an important distinction is made between intercourse through the private part and other forms of physical intimacy.

First: Intercourse Through the Private Part

Intercourse through the private part during menstruation is prohibited. According to the majority of scholars, it also remains impermissible after the bleeding stops until the woman performs Ghusl.

Second: Intimacy With a Cloth or Covering Between the Navel and Knees

A form of intimacy in which the woman wears a cloth or covering between the navel and knees has been considered permissible in Islamic legal texts, because the prohibited act of intercourse through the private part is avoided.

Third: Other Forms

There are further details concerning different forms of intimacy, and jurists have discussed various situations separately. Therefore, every form should not automatically be given the same ruling. In a practical personal situation, it is better to explain the exact circumstances to a qualified scholar and seek guidance.

Conclusion

The rulings of menstruation are not limited to prayer and fasting. They also include important matters concerning Hajj, Tawaf, the Quran, the mosque, marital relations, and divorce.

The main points discussed in this article are:

  • A menstruating woman may perform the other rites of Hajj, but she should delay Tawaf until she becomes pure.
  • Scholars have discussed the prohibition of directly touching the Quran during menstruation.
  • There is a difference of opinion regarding oral Quranic recitation by a menstruating woman. The Hanafi position is that regular oral recitation is not permitted, while the Maliki school has a well-known position allowing it. Ibn Taymiyyah and Ibn Baz رحمهما الله also held the view that oral recitation is permissible.
  • Oral recitation and directly touching the physical Mushaf are two separate issues.
  • A menstruating woman is generally not permitted to remain inside the mosque, while narrations also indicate room for passing through or taking something from the mosque when there is a need and there is no fear of contamination.
  • Intercourse through the private part during menstruation is prohibited.
  • Scholars have differed over whether an expiation for intercourse during menstruation is obligatory or recommended.
  • There is also discussion regarding whether the expiation is one dinar or half a dinar.
  • According to the majority of scholars, intercourse is not permitted after menstrual bleeding stops until the woman performs Ghusl.
  • The ruling concerning expiation may differ depending on whether the woman willingly participated or was forced.
  • Considering intercourse during menstruation to be permissible is a very serious religious matter, while declaring a particular individual to be a disbeliever is a matter for qualified scholars.
  • Divorce during menstruation is not the prescribed method; the prescribed timing and procedure of divorce should be followed.
  • Ordinary marital interaction remains permissible during menstruation, apart from intercourse through the private part.
  • A form of intimacy with a cloth or covering between the navel and knees has been considered permissible in Islamic legal texts.

Important Note

Some practical issues related to menstruation are complex and cannot always be determined from general principles or a short article. In some cases, a woman’s previous menstrual habit, the number of days of bleeding, intervals of purity between bleeding, and whether the bleeding is continuous or irregular must also be considered. In addition, some rulings differ between the various schools of Islamic jurisprudence.

Therefore, if a woman experiences a complicated situation involving changes in her normal menstrual pattern, continuous or irregular bleeding, or uncertainty about whether the bleeding is menstruation or Istihada, she should explain her complete situation to a qualified Islamic scholar or a reliable Darul Ifta and seek guidance.

A final ruling about prayer, fasting, or other Islamic obligations should not be made solely on the basis of general information.
